Online Store Terms and Conditions

I. GENERAL PROVISIONS
1. The Des Monts online store, available at https://..., is operated by Illustrations Aleksandra Sojczyńska, with its registered office at Antka, 9/19, 05-800 Pruszków, Mazovia, Poland., Tax Identification Number NIP: PL5342660630 | REGON: 524404625 (hereinafter referred to as the "Seller").
2. The Seller may be contacted via e-mail at desmonts.office@gmail.com.
3. These Terms and Conditions set out the rules governing the use of the Online Store, including in particular the placing of Orders, the conclusion of Sales Agreements, payments, delivery of Goods, withdrawal from the Sales Agreement, and the submission of complaints.
4. These Terms and Conditions apply to all Customers using the Online Store.
5. Sales Agreements concluded through the Online Store shall be governed by the laws of Poland, without prejudice to the mandatory consumer protection provisions of the laws applicable under European Union legislation.
6. Matters not governed by these Terms and Conditions shall be subject to the applicable provisions of Polish law and the relevant provisions of European Union law.
7. Providing personal data is voluntary; however, it is necessary for the processing and fulfilment of an Order. Detailed information regarding the processing of personal data is set out in the Privacy Policy.
8. Sales Agreements concluded through the Online Store shall be made in the language selected by the Customer from the language versions available in the Online Store.
II. DEFINITIONS
For the purposes of these Terms and Conditions, the following definitions shall apply:
1. Seller – Illustrations Aleksandra Sojczyńska, operating the Des Monts Online Store.
2. Online Store (or Store) – the online store available at https://desmontsbrand.com.
3. Customer – a natural person, legal entity, or organisational unit with legal capacity purchasing Goods through the Online Store.
4. Consumer – a Customer who is a natural person acting for purposes outside their trade, business, craft, or profession.
5. Entrepreneur with Consumer Rights – a natural person conducting business activity who is granted consumer rights under the applicable provisions of Polish law.
6. Goods – products offered for sale in the Online Store.
7. Order – a declaration of intent submitted by the Customer for the purpose of concluding a Sales Agreement for Goods.
8. Sales Agreement – a distance sales agreement concluded between the Seller and the Customer through the Online Store.
9. Customer Account – an individual account created within the Online Store, enabling the Customer to access selected Store functionalities.
10. Terms and Conditions – these Terms and Conditions of the Online Store.
III. PLACING ORDERS
1. Orders may be placed through the Online Store 24 hours a day, 7 days a week via the Store's website.
2. To place an Order, the Customer shall:

select the Goods and add them to the shopping cart;

provide the information necessary to complete the Order;

select the preferred delivery and payment methods;

accept these Terms and Conditions;

confirm the Order and make payment, where applicable.
3. After placing an Order, the Customer will receive an e-mail confirming that the Order has been received for processing.
4. The Sales Agreement is concluded upon the Seller's confirmation of acceptance of the Order.
5. The Seller reserves the right to refuse to process an Order if the Customer provides false or inaccurate information, fails to make the required payment, or if other circumstances prevent the fulfilment of the Order, as well as in other cases provided for by applicable law.
6. Product photographs, visualisations and descriptions are provided for illustrative purposes only. The Seller makes every reasonable effort to ensure that they accurately represent the Goods offered for sale; however, the appearance of the Goods, including their colours, may vary depending on the Customer's monitor or device settings.
7. The Seller reserves the right to update product descriptions, photographs, specifications and product availability, provided that such changes do not affect the rights arising from Sales Agreements already concluded with Customers.
8. All Goods offered in the Online Store are available while stocks last, unless otherwise stated in the product description. For Goods offered on a pre-order basis, information regarding their availability and the estimated fulfilment time is provided in the product description or communicated directly by the Seller.
9. An Order may only be cancelled before its fulfilment has commenced. Once the Goods have been dispatched, the Customer may exercise their statutory right of withdrawal, where such right is granted under applicable law.
IV. PRE-ORDER
1. Selected Goods may be offered on a pre-order basis. Information regarding the pre-order status and the estimated fulfilment time is provided in the product description or communicated to the Customer by the Seller prior to the conclusion of the Sales Agreement.
2. Pre-orders are fulfilled once a sufficient number of Orders has been collected or during the next production cycle for the relevant Goods.
3. As production takes place in Nepal and additional time is required for manufacturing, quality control and international shipping, fulfilment of pre-orders may take longer than for Goods that are in stock. The estimated fulfilment time is provided in the product description or communicated to the Customer before purchase and is generally no less than one month.
4. If the Seller is unable to fulfil a pre-order, the Customer will be informed without undue delay and all payments received will be refunded in accordance with applicable law.
V. PERSONALISED PRODUCTS
1. Goods manufactured according to the Customer's specifications or clearly personalised are not subject to the statutory right of withdrawal, in accordance with applicable law.
2. Before placing an Order, the Customer will be informed of the personalised nature of the Goods and of the absence of the right of withdrawal in relation to such Goods.
VI. PRICES AND PAYMENT
1. All prices displayed in the Online Store are gross prices (inclusive of applicable taxes) and are expressed in [PLN / EUR], unless stated otherwise.
2. Delivery costs are displayed during the checkout process and depend on the selected delivery method.
3. The Customer may use the payment methods available in the Online Store, including, in particular: BLIK, credit or debit card, Google Pay, Apple Pay, bank transfer, and any other payment methods made available during the checkout process.
4. Orders are processed upon receipt of payment, unless the Customer selects a payment method that allows payment at a later stage.
5. The Seller reserves the right to change the prices of Goods, organise promotions, and introduce or withdraw special offers. Such changes shall not affect Orders placed before they become effective.
6. The prices applicable at the time the Order is placed shall be binding on both parties. Delivery costs and any additional charges are displayed to the Customer before the Order is placed. Promotions, discounts and promotional codes are subject to their respective terms and conditions.
7. The Customer is required to provide accurate, current and complete information necessary for the fulfilment of the Order. The Seller reserves the right to correct obvious typographical, calculation or technical errors relating to prices, descriptions or product availability. If such an error affects an Order already placed, the Seller shall promptly inform the Customer and propose an appropriate solution in accordance with applicable law.
VII. DELIVERY
1. Goods are delivered to the countries specified in the Online Store using the delivery services made available by the Seller, including InPost.
2. Available delivery methods and the corresponding delivery costs are displayed to the Customer during the checkout process.
3. Unless otherwise stated in the product description, the estimated order processing time is [1–3] business days. The delivery time of the selected carrier must be added to the processing time.
4. The Seller shall not be liable for delays in delivery caused by the carrier or by other circumstances beyond the Seller's reasonable control.
5. The risk of accidental loss of or damage to the Goods passes to the Consumer upon delivery of the Goods. In the case of Customers who are not Consumers, the risk passes upon delivery of the Goods to the carrier.
6. The Seller shall use reasonable efforts to fulfil Orders within the estimated timeframes indicated in the Online Store. The Seller shall not be liable for delays resulting from force majeure or circumstances beyond the Seller's reasonable control, including delays caused by carriers, public authorities, customs procedures or other unforeseen events.
VIII. RIGHT OF WITHDRAWAL
1. Consumers and Entrepreneurs with Consumer Rights have the right to withdraw from the Sales Agreement without giving any reason within 14 days of receiving the Goods.
2. To exercise the right of withdrawal, the Customer must notify the Seller of their decision by e-mail or by submitting a written declaration.
3. The Goods must be returned no later than 14 days from the date on which the Customer informed the Seller of the withdrawal. Before returning the Goods, the Customer must contact the Seller to obtain the return address.
4. The Customer shall bear the direct cost of returning the Goods unless the Seller agrees to cover such costs.
5. The refund shall be made no later than 14 days from the date on which the Seller receives the Customer's notice of withdrawal. The Seller may withhold the refund until the returned Goods have been received or until the Customer provides proof of their return, whichever occurs first.
6. The Customer is liable for any diminished value of the Goods resulting from handling them beyond what is necessary to establish their nature, characteristics and functioning.
7. The right of withdrawal does not apply in the cases specified by applicable law, including, in particular, Goods that are personalised or manufactured according to the Customer's individual specifications.
IX. COMPLAINTS
1. The Seller shall be liable for the conformity of the Goods with the Sales Agreement in accordance with applicable law.
2. Complaints may be submitted by e-mail to desmonts.office@gmail.com or in writing to the Seller's registered address.
3. A complaint should include information enabling the Seller to identify the relevant Order, together with a description of the reason for the complaint.
4. The Seller shall respond to the complaint within 14 days of its receipt. Where additional information is required to process the complaint, the Seller may request that the Customer provide such information.
5. If the Goods are found to be non-conforming with the Sales Agreement, the Customer shall be entitled to the remedies provided under applicable consumer protection legislation.
X. RULES FOR USING THE ONLINE STORE
1. The Customer shall use the Online Store in accordance with applicable law, accepted standards of conduct, and these Terms and Conditions.
2. The Customer must not engage in any activity that may disrupt the operation of the Online Store, including, in particular, the use of malicious software, attempts to gain unauthorised access, automated data extraction (scraping), bots, or any other tools that interfere with the operation of the Online Store.
3. Without the Seller's prior written consent, it is prohibited to copy, download, record, reproduce, distribute or otherwise use any content available in the Online Store, including photographs, product designs, videos, music, or other materials, including for the purpose of training artificial intelligence models, creating databases, or any other commercial purpose.
4. The Customer must not impersonate the Seller, infringe the rights of third parties, or use the Online Store in any manner contrary to its intended purpose or applicable law.
5. In the event of a breach of these Terms and Conditions, the Seller may restrict or suspend access to the Online Store to the extent permitted by applicable law.
6. The Online Store operates using the Shopify platform, which provides the technical infrastructure necessary for its operation. Shopify is not a party to any Sales Agreement concluded between the Seller and the Customer.
7. The Online Store may use services, applications and tools provided by third parties. The Seller shall not be liable for their operation, availability or any changes introduced by their providers, unless such liability arises under applicable law.
XI. INTELLECTUAL PROPERTY
1. All content available in the Online Store, including, without limitation, photographs, graphics, videos, music used in the Store's materials, product descriptions, product designs and patterns, logos, trademarks and promotional materials, is the property of the Seller or the respective rights holders and is protected under applicable intellectual property laws.
2. Copying, distributing, modifying, downloading or otherwise using any materials available in the Online Store, in whole or in part, without the Seller's prior written consent is prohibited, except where permitted by applicable law.
3. Use of the Online Store does not grant the Customer any rights, title or interest in or to any content or materials made available through the Online Store.
XII. PERSONAL DATA AND PRIVACY POLICY
1. The controller of the Customers' personal data is Illustrations Aleksandra Sojczyńska, NIP: PL5342660630 | REGON: 524404625, with its registered at Antka, 9/19, 05-800 Pruszków, Mazovia, Poland.
2. Personal data is processed solely for the purposes of fulfilling Orders, maintaining Customer Accounts, handling complaints, communicating with Customers, and complying with obligations arising under applicable law.
3. Providing personal data is voluntary; however, it is necessary for the conclusion and performance of the Sales Agreement.
4. Customers are entitled to the rights granted under Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation – GDPR), including the right to access, rectify, erase, restrict the processing of, and transfer their personal data, as well as the right to object to processing, in accordance with applicable law.
5. Detailed information regarding the processing of personal data, the use of cookies, and the use of third-party service providers, including the e-commerce platform provider, payment service providers, delivery carriers, analytics and marketing service providers, and technical service providers, is available in the Privacy Policy published on the Online Store's website.
XIII. COOKIES
1. The Online Store uses cookies in accordance with the principles set out in the Cookie Policy.
XIV. SHOPIFY RELATIONSHIP
1. The Seller's Online Store operates using the Shopify platform, which provides the technical infrastructure necessary for the operation of the Online Store. All Sales Agreements are concluded solely between the Customer and the Seller.
2. Shopify and its affiliated entities are not parties to any Sales Agreement concluded through the Online Store and shall not be liable for the sale of Goods, their conformity with the Sales Agreement, order fulfilment, complaints, returns, or any loss, damage or claims arising from transactions concluded between the Customer and the Seller.
3. Any claims relating to the conclusion or performance of a Sales Agreement shall be directed exclusively to the Seller.
XV. LINKS TO THIRD-PARTY WEBSITES
1. The Online Store may contain links to third-party websites or services.
2. The Seller shall not be responsible for the content, availability, or operating practices of third-party websites.
3. The use of such websites is subject to the terms and conditions and privacy policies of their respective owners.
XVI. SELLER'S LIABILITY
1. The Seller shall exercise reasonable care to ensure that the information published in the Online Store is accurate and up to date.
2. The Seller shall not be liable for interruptions in the operation of the Online Store resulting from force majeure, technical maintenance, or other circumstances beyond the Seller's reasonable control.
3. Nothing in these Terms and Conditions excludes or limits the rights of Consumers or Entrepreneurs with Consumer Rights arising under mandatory provisions of applicable law.
XVII. DISPUTE RESOLUTION AND GOVERNING LAW
1. Sales Agreements concluded through the Online Store shall be governed by the laws of Poland. The choice of Polish law shall not deprive Consumers of the protection afforded by the mandatory provisions of the law of their country of habitual residence where such provisions apply under European Union law.
2. Consumers may use out-of-court methods for resolving disputes and pursuing claims in accordance with applicable law.
3. Any disputes arising from Sales Agreements concluded through the Online Store shall be submitted to the competent courts having jurisdiction under applicable law.
4. Any disputes with Customers who are not Consumers shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Seller's registered office.
XVIII. FINAL PROVISIONS
1. These Terms and Conditions shall become effective on the date of their publication on the Online Store's website.
2. The Seller reserves the right to amend these Terms and Conditions for valid reasons, including changes in applicable law, payment methods, delivery methods, the functionality of the Online Store, or the scope of the services provided. Any amendments shall not affect the rights and obligations arising from Orders placed before such amendments take effect.
3. Matters not governed by these Terms and Conditions shall be subject to the applicable provisions of Polish law and the relevant provisions of European Union law.
